CheerandChomp Policies and General Information Guarantee: All merchandise from CheerandChomp is unconditionally guaranteed to be free from defects of material and workmanship. Any merchandise found to be defective will be replaced by us. We make no other warranties, expressed or implied. CheerandChomp may assign determination of defective materials or workmanship to third party suppliers. If we deem merchandise as defective, return the merchandise for replacement or credit immediately. CheerandChomp is not liable for consequential or special damages due to any delay or non-fulfillment. Terms: We accept Visa, Mastercard, Paypal and school purchase orders. 1. There will be a $3.00 processing fee added to customers wishing to pay via credit card. 2. All school purchase orders MUST ship to the school. 3. School Purchase Orders are billed net 30 days from shipment date. 4. Past due invoices are subject to a 1.5% per month or maximum allowed by law finance charge 5. All returned checks will incur a $30.00 charge. Customers with accounts requiring collections will be liable for all associated costs including legal fees. Shipments: In most cases, we can guarantee a shipment date for your product, however no representative from CheerandChomp can guarantee a delivery date. We are not responsible for delays or damages by shipping companies. We makes every effort to provide accurate freight quotes. However, we cannot be responsible for differences in the quoted estimate and the actual freight charge. Additionally, If the freight carrier notifies us of an incorrect shipping address, an address correction charge of $15.00 will be billed back to you. (This is an actual charge from the Freight Companies) Changes/Cancellations: All orders requiring special handling or printing are considered firm. Any change, other than quantity, to the order once in production will be billed for any work done, plus any additional work required by the change. Changes in quantity must be made prior to the start of production. If a change in quantity occurs after the completion of any portion of production, the change will be treated as a separate order and billed accordingly. Any change made after start of production will delay shipping. If a cancellation is necessary, all costs associated with work performed to date of cancellation will be invoiced. Cancellations must be in writing and acknowledged by CheerandChomp Printing/Special Orders: Phone orders are not accepted due to the potential for error. All orders must be faxed or mailed. Orders are not put into production unless order is complete. Orders are considered complete with a correct purchase order, approved terms, complete shipping address, camera-ready art and any artwork approvals if required. In hand dates must be clearly stated on purchase order and fall within factory production schedule. Pricing: All prices are subject to change without prior notice. Call for quote for quantities not listed in catalog. Pricing does not include freight or handling charges unless specifically stated by CheerandChomp Product Colors: Product colors can vary slightly from one production to the next. PMS numbers for some products listed are not always an exact match. If color is important please request a sample. Production time for printed/special orders: Production starts once the order and the art are approved for production. Production time does not include the day the order was received. Production time is usually less than 2 weeks, depending on quantity. However, from the beginning of July to the end of October production time could be considerably longer. Call for production schedule. Depending on the season, rush orders are accepted if the production schedule allows. Rush orders must be approved by us before sending order. Rush charges may apply. Production time for below minimum orders could be up to 5 weeks. Returns: All claims must be made within 10 days of receipt of merchandise. Returns must be authorized by CheerandChomp. Any returns not authorized will be refused and returned to sender. No returns will be accepted for imprinted, special order and some unimprinted merchandise unless it is determined to be defective by us. When ordering unimprinted items it is the customers responsibility to inquire on whether that item is available for return. Returns on some unimprinted merchandise and cheerleading poms are subject to a 30% restocking fee. No replacement, discount or credit will be issued for merchandise which is unavailable for return to CheerandChomp. Governing Law: By placing a purchase order with CheerandChomp you agree that all transactions shall be governed and construed according to the laws of the State of California. Furthermore, you agree that all disputes shall be settled in Orange County, CA. Hours of Operation: 8:00 a.m. - 5:00 p.m. Monday through Friday, Pacific Time. We are closed for the following holidays: Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving and Christmas through New Year’s Day.
